Steps to Take Following a Car Accident

The immediate aftermath of a car accident is chaotic, making it difficult to take purposeful action. If you’ve suffered serious injuries in the crash, you may be incapacitated; however, if you can safely use a phone or ask a companion to use it for you, you can take proactive steps immediately to protect yourself physically and financially.

After a car accident in North Las Vegas, do the following:

  • Call 911 to report the accident and apply any necessary first aid
  • While waiting for emergency services, use the phone’s camera to snap photos of the damaged vehicles, the accident scene, and anything relevant to the cause of the accident like an intersection or traffic signs
  • Take photos of any visible injuries
  • Add the contact information of the involved driver(s)
  • If there were eyewitnesses to the accident, ask for their contact information—an eyewitness can be the key to a successful claim in places where there are no traffic cameras
  • Record what you remember about the accident (trauma sometimes fades memories later)

It’s always best to go directly to a hospital either in an ambulance or by arranging transportation from the accident scene as soon as the police clear you to leave.

This ensures that you receive medical care and provides evidence that the injuries happened in the car accident. Ask the doctor for a full medical examination to diagnose and treat any injuries with delayed symptom presentation such as whiplash, internal organ injuries, and brain injuries.

Your medical report and police report become key evidence in a Nevada car accident claim.

What Damages Can I Recover After A Car Accident?

Car accident damages involve far more than a dented bumper or scratched paint job if the accident was serious and caused injuries. Medical bills pile up at the same time that painful injuries may prevent a return to the workplace. In some cases, catastrophic injuries may cause permanent disability or impairment.

A successful car accident claim in North Las Vegas can recover compensation for damages such as the following:

  • Property damage costs
  • Past and future medical expenses
  • Lost earnings and future income loss
  • Lowered future earning ability due to disability
  • Out-of-pocket expenses such as travel costs for visiting a specialist or home assistive equipment
  • Pain and suffering
  • Any other individualized damages that apply such as loss of limb, the loss of one of the senses, scarring, facial disfigurement, loss of consortium, or diminished quality of life

If a loved one suffered fatal injuries in a car accident, a wrongful death claim could recover compensation for close family members who suffer financial losses from the death.

Car accident wrongful death claims bring compensation for funeral costs, loss of income for the remaining working years the decedent would have had left, loss of benefits like healthcare and retirement contributions, and compensation for the loss of consortium or a parent’s support and guidance.

Understanding Nevada Car Accident Laws

Nevada is one of the majority of states with fault-based car accident laws. In North Las Vegas car accidents, it matters who is responsible. The state operates on a modified comparative negligence system that assigns a percentage of fault to all drivers involved in an accident. Under Nevada §41.141 the law states the following: “In any action to recover damages for death or injury to persons or for injury to property in which comparative negligence is asserted as a defense, the comparative negligence of the plaintiff or the plaintiff’s decedent does not bar a recovery if that negligence was not greater than the negligence or gross negligence of the parties to the action against whom recovery is sought.” In other words, an injury victim may recover compensation even if they contributed to the cause of the accident as long as they are less than 50% at fault. This substantially benefits those who are partly responsible for their accident; however, it sometimes incentivizes insurance companies to assign unfair portions of fault to injury victims. For example, if one driver ran a red light and hit another driver in the intersection but the other driver was exceeding the speed limit, the insurance company could assign 75% fault to the driver who ran the red light and 25% fault to the speeding driver. If the speeding driver’s damages amount to $100,000, this reduces their compensation to $75,000. When a car accident injury victim doesn’t have proactive legal representation, an insurance company could assign them a portion of the fault that they don’t deserve. For this reason, it’s imperative that your attorney document compelling evidence of the other party’s liability.

What is a “No Fault” State?

Only a handful of states have no-fault car accident laws. In states like Florida and New Jersey, car accident victims must file claims against their own auto insurance personal injury protection (PIP) policies to recover their damages. It’s more challenging to file a lawsuit in a no-fault state which limits lawsuits only to those who suffer catastrophic injuries. In Nevada, you have a right to file a lawsuit and go to court if an at-fault party’s insurance disputes or undervalues your claim. Fault-based insurance systems may be more complex, but they help injury victims achieve the financial accountability they deserve when another driver’s carelessness or wrongdoing causes their injuries.

Common Causes of Car Accidents

Nevada residents have busy daily lives, and areas like Las Vegas see many tourists on the roads, leading to congested roadways and confusing intersections. Common causes of car accidents in North Las Vegas include:
  • Speeding
  • Distracted driving
  • Following too closely (tailgating)
  • Failure to yield the right of way in an intersection or while exiting a parking lot
  • Unsafe lane changes
  • Improper merging
  • Aggressive driving
  • Unsafe passing
  • Drunk or impaired driving
  • Fatigued driving
In some cases, hazardous road conditions, poorly planned intersections, or defective auto parts cause or contribute to serious car accidents in North Las Vegas; however, driver negligence is the most frequent case of traffic accidents.

What To Expect During Your Accident Claim

A car accident claim can be a challenging endeavor. By hiring a North Las Vegas car accident attorney, you can focus on your physical recovery while your lawyer from Bay Law focuses on your financial recovery. Your lawyer will do the following to navigate your claim:

  • Investigate all aspects of the accident by examining the police report, looking at photos and videos, visiting the site, and speaking to eyewitnesses
  • Document evidence of the other driver’s liability and any other parties who contributed to the cause of the accident
  • Calculate your economic and non-economic damages to maximize the compensation available to you
  • Present a demand package to the insurance company of the at-fault party
  • Enter negotiations with the insurer
  • Obtain an ample settlement for your damages or proceed to court

Only about five percent of car accident cases go to court. A lawsuit in court may take longer to resolve than a settlement, but sympathetic juries often award a larger compensation amount to injury victims than they’d achieve in a settlement.

Your attorney will confer with you about the benefits of going to court rather than accepting a low settlement offer.
